I've used the skull in a project before, but I contacted that artist prior. I know, from their communication to me, they do not openly release the skull especially for what can eventually be considered commercial (profitable) work. They do a case by case basis for student/portfolio work, and with credit to them. They are aware that people use the skull a lot, but have not released it as stock. You might want to contact them if you are going to continue to use the skull. It may be possible you can convince them join hR and release the skull for use. They do answer their contact form pretty quickly in my experience.
